Terms and Conditions
1) Scope of Application
These Terms and Conditions (hereinafter referred to as "T&Cs") of CS Beauty Products Cologne (hereinafter referred to as "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller regarding the goods displayed in the Seller's online store. The inclusion of the Customer's own terms is hereby rejected unless otherwise agreed.
A consumer, as defined in these provisions, is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity that acts in the exercise of its independent professional or commercial activity when concluding a legal transaction.
2) Conclusion of the Contract
The product descriptions in the Seller's online shop do not constitute binding offers on the part of the Seller but serve to enable the Customer to submit a binding offer.
The Customer can submit a binding purchase offer (order) via the online shopping cart system. The goods intended for purchase are placed in the "shopping cart." The Customer can access the "shopping cart" via the corresponding button in the navigation bar and make changes at any time. After accessing the "Checkout" page and entering personal data as well as payment and shipping conditions, all order data will be displayed on the order summary page. Before submitting the order, the Customer has the opportunity to review and modify the details or cancel the order.
If the Customer has set up a user account in the Seller's online shop before submitting their order, the order data will be archived on the Seller's website and can be accessed by the Customer via their password-protected user account. By clicking the final button "Buy Now," the Customer submits a legally binding contract offer concerning the goods in the shopping cart.
The Customer will first receive an automatic email confirming receipt of their order, which does not yet constitute acceptance of the offer. Acceptance of the offer (and thus conclusion of the contract) takes place within two days via confirmation in text form (e.g., email), in which the Customer is informed of the execution of the order or delivery of the goods (order confirmation). If the Customer does not receive such notification, they are no longer bound by their order. Any services already provided will be refunded promptly in this case.
The order processing and transmission of all information required in connection with the conclusion of the contract are carried out via email, some of which is automated. The Customer must ensure that the email address provided by them is accurate and that receipt of emails is technically ensured, especially not prevented by spam filters.
3) Cancellation Policy
Consumers are entitled to the following right of withdrawal, whereby a consumer is any natural person who enters into a legal transaction for purposes predominantly not attributable to their commercial or independent professional activity:
Right of Withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, take possession of the last goods.
To exercise your right of withdrawal, you must inform us (Coily and Care, Alteburger Straße 306, 50968 Cologne, Germany, Tel.: +49 152 55274455, Email: contact@coilyandcare.com) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the withdrawal form template provided, but it is not mandatory.
Consequences of Withdrawal:
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs arising if you chose a delivery method other than the most cost-effective standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we receive notice of your withdrawal.
We will use the same payment method for the refund that you used for the original transaction unless expressly agreed otherwise; in no case will you be charged for this refund. We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods to us without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you dispatch the goods before the fourteen-day period expires.
You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods if this loss in value is due to handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
4) Prices and Payment Methods
The prices listed in the respective offers represent total prices. They include all price components, including statutory VAT. Delivery and shipping costs are not included in our prices.
The following payment methods are offered:

- Credit Card (American Express, Mastercard, or VISA)
- PayPal
- Voucher with PIN
- Instant Bank Transfer (SOFORT)
For prepayment by bank transfer, payment is due immediately after the contract is concluded unless otherwise agreed. The Customer transfers the invoice amount to the Seller within 10 days, specifying the purpose of payment, to the following account:

5) Delivery Time
Standard deliveries within Germany are free of charge for orders of 45 euros or more. The order total refers to the subtotal for all products in an order minus any discounts. For orders with a total below this amount, a flat shipping fee of 4.95 euros applies for delivery within Germany. Many products also offer additional delivery options, such as express shipping. If specific delivery options are not selectable during the ordering process, they are unfortunately unavailable.
If the delivery of goods fails for reasons attributable to the customer, the customer bears the reasonable costs incurred by the seller as a result. This does not apply to the costs of the initial shipment if the customer effectively exercises their right of withdrawal. Regarding return shipping costs, the provisions outlined in the seller’s cancellation policy apply.
The seller reserves the right to withdraw from the contract in the event of incorrect or improper self-delivery. This applies only if the seller is not responsible for the non-delivery and has made reasonable efforts to procure the goods through a specific covering transaction with the supplier. The seller will make all reasonable efforts to procure the goods. In the event of unavailability or only partial availability of the goods, the customer will be informed immediately, and the payment will be refunded promptly.
Public holidays in Germany, which vary by region, can affect the delivery time of your order and may delay delivery by up to two business days following the holiday.
6) Right of Retention, Reservation of Ownership
The customer is entitled to exercise a right of retention only insofar as their counterclaim arises from the same contractual relationship.
The goods remain the property of the seller until full payment of the purchase price has been made.
7) Warranty and Complaint Procedures
The statutory liability for defects applies.
As a consumer, you are encouraged to inspect the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to report any complaints to the seller and the carrier as soon as possible. Failure to comply with this request does not affect your statutory warranty rights.
Product images may not always correspond to the appearance of the delivered goods. In particular, changes in the appearance and features of products may occur due to the manufacturer's updates or assortment renewals. Warranty claims do not apply in such cases as long as the changes are reasonable for the customer.
If a feature of the goods deviates from the objective requirements, the deviation is considered agreed only if the seller has informed you of it before you submitted your contractual declaration and the deviation was expressly and separately agreed upon by the contracting parties.
8) Applicable Law
This contract and all legal relationships between the parties are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If any provision of this contract is or becomes invalid or contains a gap, the remaining provisions shall remain unaffected.
9) Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR) at the following link: https://ec.europa.eu/consumers/odr.
This platform serves as a contact point for the out-of-court resolution of disputes arising from online purchase or service contracts involving a consumer.
The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
